Around the country, state and local lawmakers are increasingly focused on equal pay, with the goal of eliminating the persistent wage gap between male and female workers. California, Maryland, Massachusetts, Oregon, and New York have enacted wide ranging equal pay legislation. Multiple cities, including New York City and Philadelphia, have passed laws prohibiting employers from asking applicants about their pay history. Other states and localities are considering similar legislation and the existing statutes have already been expanded. These new laws will increase the risk of equal pay and pay discrimination claims. We will address the requirements associated with this new wave of anti-discrimination legislation, explore how to evaluate compliance, and discuss best practices for mitigating risk.
