The Case

It’s every HR practitioner’s worst nightmare: a day in court. In this exciting, interactive session, you will experience firsthand what happens when an employee files a harassment lawsuit. This year’s case focuses on alleged sexual harassment. At trial, the parties will present conflicting testimony. Was this relationship consensual or not? Was the HR department given notice after the first incident was reported? Is the company liable for the alleged harassment if HR knew and did nothing to stop it? Which type of sexual harassment allegedly happened? Quid pro quo or hostile working environment? What are the differences? Does it matter who the alleged harasser is…male v. female? 


Join attorneys from Woods Rogers’ Labor and Employment Team for an actual courtroom (mock) trial followed by jury deliberations. Richmond SHRM provides a front row seat to the trial with closed camera viewing of the jury’s deliberation. Following the jury’s decision, the attorneys will discuss the key twists and turns of the case. Audience questions are encouraged!

About Our Speakers

Leah M. Stiegler is a member of the firm’s Labor and Employment and Litigation practice groups. Leah’s employment practice focuses on helping employers comply with various employment laws, defending related employment actions with the Equal Employment Opportunity Commission and in state or federal court, conducting workplace and board training, guiding employers through workplace investigations, and working with employers regarding collective bargaining and grievances/arbitrations.

A Virginia native, Leah began her career at Woods Rogers as a summer associate in 2014 and joined the firm after completing a judicial clerkship with the Honorable Lawrence R. Leonard, U.S. Magistrate Judge for the Eastern District of Virginia, where she gained extensive experience in handling pretrial motions, discovery disputes, and settlement conferences.

Leah earned her law degree from the University of Richmond School of Law, where she graduated cum laudeand was a member of the Order of the Coif. She also served on the executive board of the University of Richmond Law Review. While in law school, Leah interned with the Honorable Kevin R. Huennekens, U.S. Bankruptcy Court.

 

Kameron V. Melton works out of Woods Rogers’ Roanoke office as a member of the Labor & Employment and Litigation practice groups. Kameron began her career at Woods Rogers as a summer associate in 2017 and joined the firm as an associate in 2018 after completing judicial internships with the Honorable Justice Cleo F. Powell, Supreme Court of Virginia and the Office of Chief Staff Attorney of the Supreme Court of Virginia.

While at the College of William and Mary, Kameron served as a President’s Aide, a student advisory board member to the President of the college) and Secretary of the class of 2015. In law school, she also served as the Student Bar Association Community Service Chair and was a student advisory board member to the Dean of the law school as a Dean’s Associate. In addition, Kameron represented underserved students with disabilities through the Special Education Advocacy Clinic (PELE). In 2017, Kameron was honored to receive the Dr. Perneller Chubb-Wilson Award from the Roanoke Chapter of the Southern Christian Leadership Conference.

 

Patice L. Holland, a principal in Woods Rogers’ Roanoke office, is an attorney with a diverse litigation practice and experience. She focuses primarily on employment litigation defense, transportation law (FELA, SAA, LIA), general civil and commercial litigation, real estate and commercial and residential landlord-tenant litigation, intellectual property, and insurance defense.

She has extensive experience litigating cases in state and federal court as well as in mediation. Through her litigation experience, Patice has garnered extensive knowledge in defending witness and document subpoenas and FOIA requests.

Patice is an inaugural member of the Virginia Lawyers Weekly 2016 group of Up and Coming Attorneys. In 2019, she was named as an inaugural member of the Virginia Lawyers Weekly 2019 Influential Women of Law.

Victor Cardwell is Chairman of Woods Rogers and Co-Chair of the firm’s Labor and Employment Law team. He practices labor and employment law throughout the U.S., focusing on diversity, the Fair Labor Standards Act, and labor/management relations—including union-organizing campaigns and union-avoidance techniques, and workplace violence. Victor has significant experience before state and federal courts and administrative agencies, including the National Labor Relations Board. He offers counsel to executives and human resources managers on a wide range employer concerns—from harassment and discrimination, to sexual orientation/transgender issues, and retaliation matters. He also counsels employers on workforce reductions, handbooks and agreements, unfair competition, wage/hour compliance, health and disability, discipline/discharge, and employee leave.

Victor is a member of the Board of Governors of the Virginia Bar Association. He is also a member of the Virginia State Bar’s Board of Governors for its Diversity Conference was named to the Roanoke Law Foundation Fellows Program in 2018. He has received Virginia Lawyers Weekly’s “Leaders in the Law” recognition.

Tom Winn
is a Principal and CoChair of the Labor and Employment practice team at Woods Rogers, where his nationwide practice focuses on HR counseling, employment litigation, and traditional labor issues. Best Lawyers in America named Tom as the 2016 Roanoke Lawyer of the Year for Labor Law-Management. Tom was named to the Roanoke Law Foundation Fellows Program in 2018.Tom advises management on HR issues ranging from discipline/discharge, workforce reductions, handbooks and agreements, harassment, discrimination and retaliation, wage/hour compliance, health and disability, employee leave and benefits, and unfair competition. Tom represents employers in litigation regarding these issues before state and federal courts and administrative agencies, including the EEOC, DOL, and OFCCP. He has served as “first chair” counsel at both trial and appellate levels. Tom also handles union organizing and decertification campaigns, collective bargaining, grievances/arbitrations, NLRB litigation, strike management, and other issues under collective bargaining agreements.
 

Fielding Douthat is a member of Woods Rogers’ Labor and Employment and Business and Corporate teams and serves clients from the firm’s Richmond office. Fielding counsels employers on internal investigations, litigation avoidance and management, employee relations (hiring, discipline and termination), reductions in force, labor relations, independent contractor relations, and compliance with federal, state and local employment laws.

 

He also has experience litigating issues relating to the Fair Labor Standards Act, the Family and Medical Leave Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, Title VII, the Worker Adjustment and Retraining Notification Act, and similar state laws. For clients whose employees work under collective bargaining agreements, Fielding handles all facets of labor litigation, including representing management in grievances, arbitrations, unfair labor practice proceedings, and bargaining matters.

 

Law & Politics magazine recognized Fielding as a Virginia Super Lawyer for Employment Law and Virginia Business magazine named him a “Legal Elite” for Labor/Employment Law. In addition to his labor and employment practice, Fielding works on residential and commercial land use matters. He has litigated cases involving cellular telephone tower leases, easements, timber contracts, business torts, commercial contracts and general liability matters.

Program has been approved by SHRM for 3 PDC towards SHRM-CP and SHRM-SCP recertification and submitted to HRCI for 3 (General) credit towards PHR, SPHY and GPHR recertification.
